Stroz Friedberg was retained by a consortium of Fortune 100 companies engaged in a complex litigation matter. The eDiscovery challenges at hand: review more than six million documents to determine which should be produced to the other side and which should be retained as privileged within a very short time period. To assist with this task, we employed Stroz Review, our proprietary review and hosting platform, to search, cull, and identify duplicate and near duplicate documents. Additionally, we employed our cutting edge Intelligent Privilege Filter tool to identify the potentially privileged documents and categorize them according to level of privilege, thus setting priorities for attorney review.
As the project commenced, the client consortium devoted a team of more than 50 attorneys to conduct the manual review “doc-by-doc” while also using the Intelligent Privilege Filter tool to look for documents that should be withheld or redacted on the basis of privilege. After nearly six weeks of almost round-the-clock work, the clients compared the Intelligent Privilege Filter’s results to that of the 50 attorneys. The findings revealed that the achievements of the Intelligent Privilege Filter alone compared favorably and almost identically to those of the attorney review team’s. Given the urgency of production and a significant claw-back provision, the clients decided to forego a full manual attorney review, and rely almost exclusively on the results of the Intelligent Privilege Filter. This resulted in a massive cost savings to the clients and a production schedule that met the clients’ needs.
