Expert Testimony

Stroz Friedberg presents its results in the form of expert reports, affidavits, or testimony at depositions, hearings, and trials. Our expert witnesses are among the leading in the country in the areas of digital forensics, computer crime and abuse, electronic discovery, and financial fraud. We are credentialed, published, and certified in our areas of expertise and have years of experience pursuing the most complex and challenging work in our fields. Many of our staff have been accepted as experts in testimony in federal and state courts, and have testified as experts before criminal grand juries. We peer review all expert opinions within our firm, both among technical personnel and managers who are former litigators and prosecutors, giving further protection and depth to our conclusions. We also act as the Court’s independent expert in forensics and electronic discovery matters. Among other cases, we have:

  • Testified at trial as the government’s digital forensics expert in the Enron “Barge” trial regarding how the metadata of a smoking gun memo showed that a defendant had received, viewed, modified, and saved the memo
  • Testified at trial as the government’s computer forensics expert in the Martha Stewart prosecution regarding the collection and authenticity of electronic evidence in the case
  • Testified at trial as a digital forensics expert in a civil case involving the theft of intellectual property, attesting to the fact that most of the documents that the plaintiff claimed were misappropriated had been sent by plaintiff to defendant in the normal course of prior business dealings
  • Testified at a hearing in a civil litigation, attesting to the non-functioning state in which a party produced certain computers that allegedly housed data supporting that party’s claims
  • Testified at a deposition regarding a digital forensic analysis that identified on a witness’s computer certain computer-aided design drawings that were the subject of a claim of theft of intellectual property
  • Submitted an expert report in a civil litigation showing that an auto manufacturing defendant acted appropriately in not forensically imaging e-mail servers because of the extremely low probability that any deleted e-mails could be reconstructed from those servers
  • Acted as electronic discovery expert in a civil dispute regarding a multi-million dollar electronic processing project
  • Acted as a Special Master and advised the Court regarding the proper protocols to use in a hotly-contested electronic discovery matter
  • Testified in a criminal grand jury to rebut a subject’s claims that he did not author and send certain e-mails
  • Testified at trial as the government’s digital forensics expert in a prosecution of a militant animal rights organization regarding the co-conspirators’ use of encryption techniques and how what data could be forensically recovered from their computers illuminated their roles in the organization
  • Served as a digital forensic expert for the defense, advising on cross-examination issues and standing by for testimony, to show that the defendant did not knowingly post to a website certain illegal content
  • Testified in a criminal grand jury to rebut a subject’s claims that he did not author and send certain e-mails
